Schwartz pointed out that the XRPL requires a set of validators that includes reliable operators and smaller independent participants. The problem is that large companies often have better uptime because they can afford superior servers and support teams.

The system does not permanently remove validators. If a validator comes back online and sends matching validation votes, it can be removed from the negative UNL in a short time.

Schwartz emphasized that the key to the negative UNL is that it does not completely strip validators of their broader roles. Validators listed on this list may lose their active confirmation role during failures, but they still retain a voice in transaction ordering, fee voting, or modification voting.

The XRPL documentation also mentions that the UNL is a group of validators trusted by the server, believing they will not collude. Each UNL entry should be an independent entity, including businesses, universities, organizations, or individuals.
